Most private landlords know that a deposit must be placed into a government-approved protection scheme within 30 days of receiving it. But simply securing the money is only half the job.
The “Prescribed Information” Trap The biggest pitfall for landlords isn’t failing to protect the deposit; it is failing to serve the correct “Prescribed Information” alongside it.
Within that strict 30-day window, you must give your tenant:
- The specific scheme’s official leaflet explaining how the deposit protection works.
- A certificate detailing the deposit amount, the property address, and the scheme’s contact details.
- A document signed by you (or your agent) certifying that the information provided is correct.
If you missed just one of these steps, or if you served the documents on day 32 instead of day 30, your deposit compliance is legally defective.
The Consequences of Getting it Wrong The courts are completely unforgiving on this issue. If your deposit paperwork is flawed, any Section 21 notice you serve will be automatically invalid. Worse still, your tenant can raise a legally binding defence and counterclaim against you for up to three times the deposit amount.
